Acceptance of Terms

By accessing and using the website commonplaces.world and engaging our catering services, you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service constitute a legally binding agreement between you and commonplaces B.V., a company registered in the Netherlands with registration number 91527460 and VAT number NL834705619B01. If you do not agree to abide by these terms, please do not use our website or services.

commonplaces B.V. is a limited liability company registered in the Netherlands, operating from our registered address at Dorpsstraat 251, 1315 SH Almere, Netherlands. We provide professional catering services throughout the Netherlands and operate our website at commonplaces.world.

Services Description

commonplaces provides professional catering services including but not limited to corporate catering, wedding catering, private event catering, menu planning, food preparation, delivery, setup, and event coordination services. All services are subject to availability and confirmation through our booking process.

Booking and Reservations

All catering bookings must be confirmed in writing through our official channels. A deposit may be required to secure your booking, with the balance due according to the payment terms specified in your service agreement. Bookings are subject to availability and confirmation by commonplaces.

Booking Requirements

  • Minimum advance notice of 48 hours for standard bookings
  • Written confirmation required for all services
  • Accurate guest count and dietary requirements must be provided
  • Venue details and access information must be confirmed
  • Payment terms must be agreed upon before service delivery

Payment Terms

Payment terms will be specified in your service agreement. Generally, a deposit is required upon booking confirmation, with the balance due before or on the day of service. We accept various payment methods including bank transfers, credit cards, and other approved payment methods. All prices are quoted in Euros (EUR) and include applicable VAT.

Cancellation and Refund Policy

Cancellation policies vary depending on the type and size of your event. Generally, cancellations made more than 7 days in advance will receive a full refund minus processing fees. Cancellations made with less notice may be subject to partial charges. Specific cancellation terms will be outlined in your service agreement.

Cancellation Timeline

  • More than 7 days: Full refund minus processing fees
  • 3-7 days: 50% refund
  • Less than 3 days: No refund, full charges apply
  • Same day: Full charges apply

Food Safety and Dietary Requirements

commonplaces is committed to maintaining the highest standards of food safety and hygiene. We comply with all applicable food safety regulations in the Netherlands. Clients must inform us of any allergies or dietary requirements at the time of booking. While we take all reasonable precautions, we cannot guarantee that our food is completely free from allergens.

Intellectual Property

All content on the commonplaces website, including but not limited to text, graphics, logos, images, recipes, and software, is the property of commonplaces B.V. and is protected by Dutch and international copyright laws. You may not reproduce, distribute, modify, or create derivative works of our content without our express written permission. Our recipes, menu designs, and proprietary catering methods are trade secrets and confidential information of commonplaces.

User Responsibilities

When using our website and services, you agree to provide accurate and complete information, respect our staff and property, ensure venue access and safety requirements are met, and comply with all applicable laws and regulations. You are responsible for providing accurate guest counts, dietary requirements, and venue information.

Limitation of Liability

To the maximum extent permitted by Dutch law, commonplaces B.V. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business interruption, arising from your use of our services or website. Our total liability for any claims arising from our services shall not exceed the total amount paid by you for the specific service giving rise to the claim. This limitation of liability applies regardless of the legal theory on which the claim is based.

Force Majeure

commonplaces shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, government regulations, or pandemic-related restrictions. In such cases, we will work with you to reschedule or provide alternative arrangements where possible.

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated by reference into these Terms of Service. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

Modifications to Terms

commonplaces reserves the right to modify these Terms of Service at any time. We will notify users of any material changes by posting the updated terms on our website and updating the "Last updated" date. Your continued use of our services after such modifications constitutes acceptance of the updated terms.

Termination

We reserve the right to terminate or suspend your access to our services immediately, without prior notice, if you breach these Terms of Service or engage in conduct that we deem inappropriate or harmful to our business, other customers, or staff. Upon termination, your right to use our services will cease immediately, though provisions regarding payment obligations, intellectual property, and limitation of liability will survive termination.

Dispute Resolution

We encourage clients to contact us directly to resolve any disputes or concerns. If direct resolution is not possible, disputes will be resolved through mediation or arbitration in accordance with Dutch law. Both parties agree to attempt good faith resolution before pursuing formal legal action.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Netherlands. Any legal action or proceeding arising under these terms will be brought exclusively in the competent courts of the Netherlands, and both parties consent to the jurisdiction of such courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these terms.

Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be replaced by a valid provision that most closely matches the intent of the original provision.

Entire Agreement

These Terms of Service, together with our Privacy Policy and any specific service agreements, constitute the entire agreement between you and commonplaces B.V. regarding the use of our website and services. These terms supersede all prior or contemporaneous communications and proposals, whether oral or written, between the parties.
